Dispõe sobre a certificação de origem no âmbito do Acordo de Comércio Preferencial entre o Mercosul e a República da Índia.
O SECRETÁRIO DE COMÉRCIO EXTERIOR, DO MINISTÉRIO DO DESENVOLVIMENTO, INDÚSTRIA E COMÉRCIO EXTERIOR, no uso das atribuições que lhe foram conferidas pelo art. 15, do Anexo I ao Decreto nº 6.209, de 18 de setembro de 2007, e considerando o disposto no art. 2º, do Decreto nº 6.865, de 29 de maio de 2009, publicado no DOU, de 1º de junho de 2009,
Resolve:
Art. 1º Para a viabilidade da adoção das providências de competência dos órgãos federais envolvidos, com vistas à execução das regras de origem estabelecidas no Anexo III do Acordo de Comércio Preferencial entre o Mercosul e a República da Índia, promulgado pelo Decreto nº 6.864, de 29 de maio de 2009, a Secretaria de Comércio Exterior torna público o modelo de Certificado de Origem contido no Anexo da presente Portaria, na versão em inglês.
Art. 2º O supracitado Certificado de Origem deverá ser preenchido em inglês em conformidade com as notas constantes no verso do modelo de formulário contido no Anexo da presente Portaria.
Art. 3º O Certificado de Origem é o documento destinado a declarar que as mercadorias de que trata cumprem com as disposições sobre origem estabelecidas no Acordo de Comércio Preferencial entre o Mercosul e a República da Índia, a fim de que possam se beneficiar do tratamento preferencial estabelecido no referido Acordo.
Art. 4º Os controles a posteriori dos Certificados de Origem efetuar-se-ão por amostragem ou sempre que as autoridades aduaneiras do Brasil, ou a Secretaria de Comércio Exterior, tenham dúvidas fundadas quanto à autenticidade do documento, à qualidade de originário dos produtos em causa ou quanto ao cumprimento dos requisitos estabelecidos no Anexo III do Acordo de Comércio Preferencial entre o Mercosul e a República da Índia.
Art. 5º As entidades autorizadas pela Secretaria de Comércio Exterior para emitir Certificados de Origem, nos termos da Circular SECEX nº 29, de 29 de maio de 2009, ou as suas sucessoras, quando for o caso, poderão emitir Certificados de Origem para o Acordo de Comércio Preferencial entre o Mercosul e a República da Índia, desde que tomem todas as medidas necessárias para verificar o caráter originário dos produtos e o cumprimento dos requisitos estabelecidos no Anexo III do citado Acordo.
Art. 6º Esta Portaria entra em vigor na data da sua publicação.

I - To qualify for preference, products must:
a) fall within a description of products eligible for concessions in the country of destination under this agreement.
b) comply with India-Mercosur PTA Rules of Origin. Each Article in a consignment must qualify separately in its own right; and
c) comply with the consignment conditions specified by the India-Mercosur PTA Rules of Origin. In general products must be consigned directly within the meaning of Rule 13 hereof from the country of exportation to the country of destination.
II - Entries to be made in Box 10
Preference products must be wholly produced or obtained in the exporting Contracting Party in accordance with Rule 4 of the India-Mercosur PTA Rules of Origin, or where not wholly produced or obtained in the exporting Contracting Party must be eligible under Rule 3 or Rule 5 of the India-Mercosur PTA Rules of Origin.
a) If Products are wholly produced or obtained enter the letter 'A' in box 10.
b) Products not wholly produced or obtained; the entry in box 10 should be as follows:
- Enter letter 'B' in box 10 for products, which meet the origin criterion according to Rule 5. Entry of letter would be followed by the sum of the value of materials, parts or produce originating from non-contracting parties or undetermined origin used, expressed as a percentage of the f.o.b. value of the products; (example B( ) percent).
- Enter letter 'C' in box 10 for products, which meet the origin criteria according to Rule 3. Entry of letter 'C' would be followed by the sum of the aggregate content originating in the territory of the exporting Contracting Party expressed as a percentage of the f.o.b. value of the exported product: (example 'C' ( ) per cent).
